Legislative Committee Kills "Bad Faith" Workers' Comp Bill

Following our investigation into insurance companies hiring doctors who side in their favor to deny workers' comp claims, a legislative committee has killed a bill to keep those cases out of court. 

The South Dakota Senate Commerce and Energy Committee voted 6-1 to kill Senate Bill 145, which would have prevented South Dakota workers who were treated unfairly by insurance companies from taking their workers' comp claims to court. 

The committee heard three hours of testimony on Tuesday from proponents in the insurance industry to opponents, made up of trial attorneys and injured workers. 

One lawmaker even testified against the bill. Representative Tim Rounds is an independent insurance adjuster who investigated workers' comp claims. But Rounds got hurt on the job and his own claim has been denied for more than two years.
